1. Acceptance of Terms

Welcome to the BeMariner Platform ("BeMariner", "Platform", "we", "us", or "our"). By accessing or utilizing our website, directories, community forums, or related services, you explicitly agree to comply with and be bound by these Terms and Conditions. These Terms constitute a legally binding agreement in compliance with the Information Technology Act, 2000 (India), globally applicable IT directives, and international maritime compliances.

If you do not agree with any of these terms, you are prohibited from utilizing or accessing this Platform.

2. Age Eligibility & Verification

Access to the BeMariner platform requires you to be at least eighteen (18) years of age to independently form a legally binding contract under the Indian Contract Act, 1872.

If you are under 18 years of age (e.g., a junior pre-sea cadet), your usage of this Platform must be under the direct supervision and legally binding consent of a parent or strictly recognized legal guardian who agrees to be bound by these Terms. We reserve the absolute right to terminate accounts that fail to meet these age requirements.

3. Maritime & DG Shipping Compliance

BeMariner operates as a unified technological hub for mariners and maritime institutes. You acknowledge and strictly adhere to the following framework:

  • Profile Authenticity: All data provided, including Continuous Discharge Certificate (CDC) mapping, INDoS numbers, sailing records, and STCW documentation must be strictly authentic. Providing counterfeit sea-service records constitutes fraud and is punishable under global maritime law.
  • Institute Listings: Our directory lists Directorate General of Shipping (DG Shipping) approved courses alongside global equivalents. While we strive for absolute accuracy, the final responsibility lies with the mariner to cross-verify the institute's current valid approval status explicitly via official DGS portals before executing financial transactions.

4. User Accounts & Security

When creating an account, you assert that your credentials are secure and confidential. We strictly utilize One-Time Password (OTP) verification and high-encryption tokenization to safeguard your sessions natively. You are solely responsible for any activity executed under your account. Any unauthorized access targeting our servers will be prosecuted vigorously under pertinent Cyber Laws globally and within Indian jurisdiction (Section 43 & 66 of IT Act, 2000).

5. Platform User Conduct

As a professional networking and development environment for Seafarers, you agree NOT to:

  • Disseminate false nautical or professional advice that could compromise maritime safety operations.
  • Post, share, or transmit defamatory, abusive, or explicitly unethical content targeting fellow seafarers, ranking officers, or registered maritime faculties.
  • Attempt to scrape, brute-force, or illegally manipulate our databases, directory endpoints, or background logic through automated bots.

6. Limitation of Liability

BeMariner serves exclusively as a digital bridge. We are not a shipping company, recruitment agency, or maritime institute. Consequently, under no circumstances will BeMariner, its directors, or its operatives be liable for:

  • Visa rejections, expired certifications, or inability to secure sea-time resulting from courses booked through our platform.
  • Disputes arising dynamically between Seafarers and third-party Institutes mapped on our site.
  • Incidental or systemic damages originating from unexpected platform downtime while at sea or in low-bandwidth global waters.

7. Governing Law

These terms shall be exclusively governed by and construed strictly in accordance with the laws of India. Any and all disputes arising directly or indirectly out of these terms shall be subject exclusively to the binding jurisdiction of the courts geographically situated in New Delhi, India.
